What Is a Lease Termination Letter?
A lease termination letter is written notice from a landlord that a tenancy is ending and when. To write one: confirm the notice period required by state law and the lease, state the full property address and the exact end date, say how many days of notice you are giving, then cover the move-out logistics — inspection, keys, forwarding address and the security deposit. This Is Not an Eviction Notice
Worth being direct about, because a lot of people arrive at a page like this looking for the wrong document. A lease termination letter ends a tenancy that is running normally: the term is up, a month-to-month arrangement is ending, both parties agreed, or the lease itself provides for early termination.
Removing a tenant for unpaid rent or a lease breach is a different process entirely. It begins with a statutory notice — a pay-or-quit or cure-or-quit notice — whose required wording, delivery method and cure period are set by your state and often your city, and it proceeds through the courts if the tenant does not comply. A generic template would be defective in most jurisdictions, so this generator does not produce one. For that situation, speak to a local attorney or your housing court.
Two things are illegal everywhere in the US regardless of what a tenant has done: so-called self-help evictions — changing locks, removing belongings, shutting off utilities — and terminating in retaliation for a complaint or repair request. Both convert a manageable problem into an expensive one.
How Much Notice Must a Landlord Give?
Thirty days is the common baseline for month-to-month, but the range is wider than most landlords expect. Several states require 60 days. Some require 90 for tenancies over a year, for older tenants, or in rent-regulated housing. Fixed-term leases usually set their own non-renewal notice on top of that.
Check the state rule and the lease together, and use the longer one. Notice that is too short is generally treated as no notice at all, which means starting again — and a tenant who has already made plans around your date will not be pleased to restart the clock.
Just-cause jurisdictions.A growing number of states and cities require a legally recognized reason even to decline renewal. Where those rules apply, an ordinary non-renewal letter is not enough on its own. If you are unsure whether your city has them, that is worth ten minutes of checking before you send anything.
What to Include, and What to Avoid
Include the tenant's name, the full address with unit, the date of the letter, the end date, the notice period given, and your signature. Then the logistics: an inspection offer, key return instructions, a request for a forwarding address, and when the deposit will be returned. Deposit deadlines are state-set and run from roughly 14 to 60 days, frequently with penalties for missing them.
Avoid explaining yourself at length.Where no reason is required, giving a detailed one creates an argument that did not need to exist and can look like a pretext later. The letters above state the ending plainly and stop.
Avoid an adversarial tone.Most tenancies end without anyone doing anything wrong. A letter that reads as a reprimand for a tenant who simply reached the end of a lease is how a routine move-out becomes a deposit dispute.
Avoid informal delivery.A text message is not notice. Follow the lease; where it is silent, certified mail with return receipt gives you a dated record.
