What Is a Notice to Vacate?
A notice to vacate is a written letter telling your landlord that you are moving out and when. To write one: check your lease for the required notice period, state the full property address and an exact move-out date, give a forwarding address for your security deposit, then sign and date it. That is the whole document — three short paragraphs. The generator above assembles it and counts the notice days for you.
Two details do most of the work. The date must be an actual calendar date, because that is what your rent obligation is measured against. And the notice must be delivered the way your lease says — notice sent the wrong way can be treated as never given.
How Much Notice Do You Have to Give?
Thirty days is the most common requirement for a month-to-month tenancy, and it is what most people assume. It is not universal. Some states require 60 days. Some require notice equal to the rent period. Many fixed-term leases set their own figure for non-renewal, often 30 or 60 days before the end date.
Your lease is the first place to look, and it usually states the number plainly. Where the lease and state law differ, the longer period generally governs. Getting this wrong is expensive in a specific way: give 30 days where 60 were required and you can owe rent for the month you were not living there.
A fixed-term lease that simply reaches its end date still usually needs written notice that you are not renewing. Several leases roll automatically into month-to-month, or into a fresh term, if neither side says anything. Assuming a lease expires by itself is one of the more common and costly mistakes tenants make.
Getting Your Security Deposit Back
The notice is where the deposit process starts, which is why the generator includes a forwarding address and a request by default. Deposit return deadlines are set by state law and vary widely — roughly 14 to 60 days after the tenancy ends — and most states also require an itemized statement of any deductions within that window. Look up your own state's figure, because knowing it is what tells you when to follow up.
Three things improve your odds more than any wording: offer a move-out inspection and attend it, photograph every room after you have cleared out, and put your forwarding address in writing. A landlord who cannot find you has an easy explanation for a late deposit.
Note the tone of the letter above. You may well need this person for a reference on your next application, and deposit disputes are the most common landlord-tenant conflict there is. Opening with demands makes both outcomes harder, which is why nothing in these templates does.
Mistakes to Avoid
Verbal notice.Telling your landlord in conversation is not notice, and it leaves you with nothing when the date is disputed. Put it in writing even where you are on friendly terms.
Ignoring the delivery method.Many leases specify certified mail or delivery to a particular address. If yours does, follow it exactly, and keep the receipt.
A vague date. "End of next month" is not a date. Name the day.
Assuming leaving early ends the rent.Moving out on the 15th after giving notice to the 31st usually still leaves you owing to the 31st. Vacating early and the tenancy ending are different things.
One signature on a shared lease.If several people are named on the lease, one tenant's notice does not always end it for everyone. Where you are all leaving, have everyone named sign.

Can my landlord refuse my notice to vacate?
