What Is a Job Offer Letter?

A job offer letter is a short written document in which an employer formally offers a role and sets out its main terms. It should include the job title, the employment type, the compensation and how often it is paid, the start date, the work arrangement, any benefits, a statement that employment is at-will, a line confirming the letter is not a contract of employment, a deadline to respond, and signature lines for both parties. That list is the whole job. The generator above produces it in about a minute, and adds the two legal clauses automatically so they cannot be forgotten.

Most offers are made verbally first and confirmed in writing the same day. The written version is what stops a disagreement six months later about what was actually agreed on pay, hours or start date.

Offer Letter vs Employment Contract

These are not the same document, and the difference matters more to the employer than to the candidate.

An offer letter confirms that a job is being offered and summarizes its key terms. It is deliberately not binding as to duration: in an at-will state it does not promise employment for any particular length of time, which is why the disclaimer belongs in it.

An employment contractcreates enforceable obligations on both sides — a fixed term, notice periods, severance, restrictive covenants, defined grounds for termination. Most US employees never receive one; they are usual for executives, specialists, and fixed-term or commission-heavy roles.

The trap is writing an offer letter that behaves like a contract without meaning to. Phrases such as "you will have a permanent position with us" or "annual salary" without a stated pay period have both been used to argue that an employer promised employment for a year or indefinitely. Keep the language descriptive, state the pay period, and leave the at-will and non-contract clauses in.

What to Include

The required elements are the job title, the employment type, the compensation with its period, the start date, the work arrangement, the reporting line, and both signatures. Add benefits if you are offering them, and a response deadline so the offer does not sit open indefinitely.

At-will employment.Nearly all US employment is at-will by default, meaning either side can end the relationship at any time, with or without cause. Stating it explicitly prevents the letter being read as a guarantee. Montana is the notable exception, and several states narrow how at-will operates, so check your own state if the role is senior or the stakes are high.

The non-contract line.One sentence — that the letter is not a contract of employment and does not guarantee employment for any specific period. It is the cheapest protection available to a small employer, and the generator includes it in every letter it produces.

What to leave out: anything you have not decided yet, performance promises, bonus figures you cannot commit to, and detailed policies that belong in a handbook. Every extra promise in an offer letter is a promise you can be held to.

Mistakes to Avoid

Language that implies job security.The most expensive mistake on this page. "Permanent", "long-term", "as long as you perform" — each has been argued as creating an implied contract that overrides at-will status. Say what the job is, not how long it will last.

Vague compensation."$62,000" without a period is ambiguous, and stating a salary as an annual figure has been read as promising a year of employment. Always pair the number with how it is paid.

No response deadline.An open-ended offer lets a candidate hold your role while they finish another process. Three to seven days is normal.

Offering benefits to a contractor.Extending employee benefits to an independent contractor is one of the factors used to argue they were really an employee, with back taxes attached. The tool above removes the benefits options entirely when you select a contract engagement.

Sending it before checks clear.If the offer depends on references, a background check or right-to-work verification, say so in the letter. Withdrawing an accepted offer is far messier than making it conditional in the first place.

How do you write a job offer letter?

State the role, the employment type, the pay and the start date in the first two paragraphs. Add benefits if you are offering any, then close with an at-will statement, a line confirming the letter is not a contract, and a deadline to respond.
